1. AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Greenstreat Holding Pty Ltd, doing business as Greenstreat Australia (“Greenstreat Australia,” “we,” “us,” or “our”), concerning your access to and use of the website https://greenstreat.com.au, as well as any other media form, media channel, mobile website, mobile application, or Greenstreat service (collectively, the “Site”).

By accessing the Site, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.

We reserve the right to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms. Please ensure that you check these Terms every time you use our Site so that you understand which terms apply. Your continued use of the Site following any changes indicates your acceptance of the revised Terms.

The Site is intended for users who are at least 13 years of age. All users who are minors (under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and its content, including but not limited to text, graphics, audio, video, code, databases, functionality, and logos (collectively, the “Content”), are owned or controlled by us or licensed to us, and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited license to use the Site solely for your personal, non-commercial use.

You may not copy, reproduce, distribute, publish, or otherwise exploit the Site or its Content without prior written permission.

3. USER REPRESENTATIONS

By using the Site, you represent and warrant that:

You have the legal capacity and agree to comply with these Terms;
You are not under the age of 13;
You are not a minor in the jurisdiction where you reside, or you have obtained parental permission;
You will not access the Site through automated means such as bots, scripts, or other non-human means;
You will not use the Site for any unlawful or unauthorized purpose; and
Your use of the Site will not violate any applicable laws or regulations.

4. PROHIBITED ACTIVITIES

You agree not to engage in any of the following prohibited activities:

Using the Site for any commercial purpose not authorized by us.
Accessing the Site through automated means or scraping data.
Uploading viruses, Trojan horses, or other malicious code.
Attempting to gain unauthorized access to the Site or disrupt its functionality.

5. USER-GENERATED CONTRIBUTIONS

The Site may allow users to post content such as reviews, feedback, and suggestions (“Contributions”). By making any Contributions, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display such Contributions.

You represent that you have the necessary rights to any Contributions and that they do not violate the rights of any third party.

6. CONTRIBUTION LICENSE

By submitting any Contributions, you grant us the right to use, reproduce, modify, distribute, and display your content as part of the Site or for marketing purposes. You retain ownership of your Contributions but waive any claims against us for using them.

7. MOBILE APPLICATION LICENSE

You are granted a limited, non-exclusive, non-transferable license to install and use our mobile application. You may not modify, reverse-engineer, or attempt to derive the source code of the application. The mobile app is provided “as is,” and we do not guarantee that it will function without errors.

8. REWARDS & LOYALTY

We offer a loyalty program known as Streat Cred, allowing you to load dollar values into your Greenstreat account. Funds in Streat Cred can only be used for goods and services at participating Greenstreat locations.

Non-Refundable Credits: Streat Cred balances are non-refundable and cannot be redeemed for cash, except as required by law.
Account Inactivity: Balances that remain unused for 12 months may expire. We reserve the right to modify or terminate the rewards program at any time, with unused credits remaining valid for 30 days after program termination.

9. SUBMISSIONS

Any feedback, suggestions, ideas, or other information you submit to us via the Site are deemed non-confidential and will become our sole property. We reserve the right to use these submissions for any purpose without acknowledgment or compensation to you.

10. THIRD-PARTY WEBSITES AND CONTENT

The Site may contain links to third-party websites or display third-party content. We are not responsible for the accuracy, content, or privacy practices of such third-party websites. Your use of any third-party website or content is at your own risk.

11. SITE MANAGEMENT

We reserve the right to:

Monitor the Site for violations of these Terms;
Remove or disable any content that violates these Terms or is otherwise objectionable;
Restrict access to the Site if necessary to protect our rights or property.

12. PRIVACY POLICY

13. REFUNDS, CANCELLATIONS, AND DELIVERY

Delivery Times: Estimated delivery times are provided but may vary due to external factors. Greenstreat is not responsible for delays caused by weather, traffic, or other uncontrollable factors.
Refunds: Refunds for orders that have already been prepared will not be granted unless there is an issue with the order, such as incorrect items or missing items.
Cancellations: Orders may not be cancelled once preparation has begun. If there is an issue, please contact customer service immediately.

14. FOOD SAFETY AND ALLERGEN INFORMATION

Greenstreat prepares food in kitchens that handle allergens such as gluten, nuts, and dairy. While we take care to prevent cross-contamination, customers with food allergies should be aware of this risk.

15. CONTACTLESS PAYMENTS

We use Stripe to process all payments securely. Your payment details are not stored on our servers. Stripe complies with the Payment Card Industry Data Security Standard (PCI DSS). Please refer to Stripe’s Privacy Policy for more information.

16. TERM AND TERMINATION

These Terms remain in effect while you use the Site. We reserve the right to terminate your access to the Site for any reason, including violation of these Terms.

17. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to modify or discontinue the Site at any time without notice. We will not be liable for any interruptions or loss of data caused by changes to the Site.

18. GOVERNING LAW

These Terms are governed by the laws of Australia. Any disputes arising under these Terms shall be resolved in the courts of Australia.

19. DISPUTE RESOLUTION

Both parties agree to attempt informal negotiations before initiating any arbitration or litigation. Disputes that cannot be resolved through negotiation will be settled through arbitration in Brisbane, Australia.

20. CORRECTIONS

We reserve the right to correct any typographical errors, inaccuracies, or omissions on the Site.

21. DISCLAIMER

The Site is provided “as is” and without warranties of any kind. Greenstreat does not guarantee the accuracy or completeness of the Site’s content.

22. LIMITATIONS OF LIABILITY

To the fullest extent permitted by law, Greenstreat will not be liable for any indirect, incidental, or punitive damages arising from your use of the Site.

23. INDEMNIFICATION

You agree to indemnify and hold Greenstreat harmless from any claims, damages, or losses arising from your use of the Site or violation of these Terms.

24. USER DATA

25. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using the Site, you consent to receive electronic communications and agree that electronic signatures are valid and enforceable as if signed on paper.

26. MISCELLANEOUS

These Terms constitute the entire agreement between you and Greenstreat. If any provision is found to be unenforceable, the remaining provisions shall remain in effect.
